General Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: The period within which the consumer can make use of their right of withdrawal.
Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
Day: Calendar day.
Long-term transaction: A distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
Durable data carrier: Any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows for future consultation and unchanged reproduction of the stored information.
Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
Entrepreneur: The natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: An agreement concluded within the framework of an organized system for distance selling of products and/or services without the simultaneous physical presence of the entrepreneur and the consumer.
Means of distance communication: A means that can be used to conclude an agreement without the consumer and the entrepreneur being together in the same space.
General Terms and Conditions: These General Terms and Conditions of the entrepreneur.
Article 2 – Right of withdrawal
The consumer has the right to withdraw from the contract within 60 days without stating reasons. During the cooling-off period, the consumer shall handle the product and packaging with care.
If the consumer exercises their right of withdrawal, they shall return the product with all accessories supplied and, if reasonably possible, in the original condition and packaging, in accordance with the entrepreneur’s reasonable instructions.
Article 3 – Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before a distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the terms can be viewed and that they will be sent free of charge upon request.
If the distance contract is concluded electronically, these terms and conditions may be made available electronically in such a way that they can be easily stored on a durable medium.
In the event that specific product or service conditions also apply, the consumer can always rely on the applicable provision that is most favorable to them.
If any provision in these terms is invalid or annulled, the rest of the agreement and terms remain in effect. The invalid provision shall be replaced with one that most closely resembles the original intent.
Situations not covered by these terms must be judged in the spirit of these general terms.
Ambiguities regarding the interpretation or content of one or more provisions must be interpreted in the spirit of these terms.
Article 4 – The Offer
If an offer has a limited validity or is subject to conditions, this will be stated explicitly.
The offer is non-binding. The entrepreneur may adjust or modify the offer.
The offer contains a complete and accurate description of the products and/or services offered.
Images used are a true representation of the products and/or services. Apparent errors do not bind the entrepreneur.
All images and specifications are indicative and cannot be grounds for damages or cancellation.
Every offer includes sufficient details so that the consumer understands their rights and obligations, including:

Any shipping costs

How the agreement will be formed
-
Whether the right of withdrawal applies
-
Payment, delivery, and performance methods
-
Validity of the offer
-
Costs of distance communication if different from the standard rate
-
Archiving of the contract and access method
-
How the consumer can review or correct the order
-
Available languages besides Dutch
-
Applicable codes of conduct and access method
-
Minimum duration for long-term contracts
-
Optional: available sizes, colors, materials
Article 5 – The Agreement
The contract is concluded when the consumer accepts the offer and meets its conditions.
If the consumer accepts electronically, the entrepreneur will confirm receipt immediately. The consumer may dissolve the contract until that confirmation is received.
If concluded electronically, the entrepreneur will implement appropriate technical and organizational measures to secure data transmission and the online environment.
The entrepreneur may check if the consumer can meet payment obligations and may refuse or attach conditions to an order if justified.
Upon delivery, the entrepreneur shall provide:

Warranty and service information

Data from Article 4(3), unless already provided

Termination rules for long-term contracts
If a long-term contract is concluded, this applies only to the first delivery.
All contracts are subject to product availability.
Article 6 – Withdrawal Right
For product purchases, the consumer may withdraw within 60 days of receipt.
During this period, the consumer must handle the product and packaging with care.
If exercising the right, the product and all accessories must be returned in original condition and packaging if reasonably possible.
The consumer must notify the entrepreneur within 60 days in writing or via email.
After notification, the product must be returned within 30 days, and proof of return must be provided.
If the consumer does not comply within the timelines, the purchase is considered final.
Article 7 – Withdrawal Costs
The return shipping costs are borne by the consumer.
If the consumer has already paid, the entrepreneur will refund the amount within 30 days of withdrawal, provided the return is confirmed.
Article 8 – Exclusion of Withdrawal Right
The entrepreneur may exclude withdrawal for certain products, provided this was clearly stated beforehand.
Withdrawal exclusion applies to:

Custom-made products
-
Personal items
-
Perishable goods
-
Items tied to financial market fluctuations
-
Newspapers and magazines
-
Unsealed media/software
-
Unsealed hygienic products
Article 9 – Price
Prices remain unchanged during the offer period, except for VAT changes.
Price changes due to financial market factors are possible and will be clearly stated.
Price increases within 3 months are only allowed if required by law.
Price increases after 3 months require agreement, and the consumer can cancel from the increase date.
Typographical errors are not binding.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that products/services conform to the agreement, specifications, and legal requirements.
Additional guarantees do not affect legal rights.
Defects must be reported within 30 days and returned in original packaging.
Warranty matches the manufacturer's period.
The warranty is void if:

The consumer or third party alters the product

The product was mishandled or used contrary to instructions

The defect is due to government regulations
Article 11 – Delivery and Execution
The entrepreneur shall exercise care in order processing and product delivery.
Orders will be delivered within 30 days unless otherwise agreed.
If delayed, the consumer will be informed within 30 days and may cancel with a refund.
If delivery is impossible, a replacement may be offered with clear notice.
Replacements do not exclude the withdrawal right.
Risk transfers upon delivery to the consumer or an appointed representative.
Article 12 – Long-term Contracts: Duration, Termination, Extension
Termination:
The consumer may terminate indefinite contracts at any time with a notice period of no more than one month.
Fixed-term contracts may be terminated at the end with the same notice.
Termination must be:

At any time

By the same method as agreement formation
-
With equal notice as the entrepreneur uses
Extension:
Fixed-term contracts cannot be automatically extended, except:

Newspapers/magazines may be extended for up to 3 months with a one-month notice.

Other products/services may only be extended for an indefinite term with up to one-month notice.
Trial subscriptions end automatically after the period.
Duration:
Contracts longer than a year may be cancelled after one year with a notice of no more than one month.
Article 13 – Payment
Unless agreed otherwise, payment must be made within seven business days after the cooling-off period begins.
For service contracts, this begins upon confirmation.
The consumer must correct incorrect payment details promptly.
In case of non-payment, the entrepreneur may charge reasonable pre-disclosed costs.
Article 14 – Complaints Procedure
Complaints must be reported within seven days of discovering the defect.
They will be answered within 14 days.
If more time is needed, a confirmation and expected reply date will be given.
Unresolved complaints may result in a dispute.
Complaints do not suspend obligations unless agreed.
If justified, the entrepreneur will replace or repair the product free of charge.
Article 15 – Disputes
Only Dutch law applies to agreements governed by these terms, even if the consumer lives abroad.
